(hereinafter the "Seller")
2. Introductory Provisions
- These Terms and Conditions govern the rights and obligations of the Seller and the Buyer in the sale of goods through the Piantado online shop (hereinafter the "Shop").
- The Buyer is either a consumer, i.e. a natural person who, outside the scope of their business activity, purchases for their own needs, or a business (in particular restaurants, hotels and shops) that purchases within the scope of its business activity. Provisions intended only for consumers or only for businesses are marked as such.
- The contract is concluded in the Czech language. Translations of the Terms and Conditions into other languages are provided for information only; in the event of any discrepancy, the Czech version prevails, unless the laws of the consumer's country provide otherwise.
- Matters not governed by these Terms and Conditions are governed by zákon č. 89/2012 Sb., občanský zákoník (Act No. 89/2012 Coll., the Civil Code), and zákon č. 634/1992 Sb., o ochraně spotřebitele (Act No. 634/1992 Coll., on Consumer Protection). A consumer residing in another EU Member State does not lose the protection afforded to them by the mandatory provisions of the laws of their country.
3. Goods and Price
- The Shop offers Argentine bone-in beef (chilled, vacuum-packed), wines and other beverages. Information about the goods, including mandatory food information, is provided for each product.
- Prices are stated inclusive of VAT in the currency of the selected market. The delivery charge is shown in the order before it is submitted.
- Meat is sold by actual weight. Each piece has a nominal weight (e.g. 600 g), and its actual weight may exceed it by no more than 10 %. For meat, therefore, the price per kilogram, the estimated price at nominal weight and the maximum price are stated. The final price is calculated as the price per kilogram × the actual weight of the piece and will never exceed the maximum price stated in the order.
- Wine, beverages and bundles have a fixed price.
- The offer and prices are valid for as long as they are displayed in the Shop. Quantities are limited; goods are reserved for 15 minutes when the Buyer proceeds to payment.
4. Order and Conclusion of the Contract
- The Buyer places goods in the reservation (basket), fills in the delivery details, and selects the delivery date and payment method. Before submitting the order, the Buyer may review and correct the details.
- By submitting the order with the "Pay" button, the Buyer confirms that they have read these Terms and Conditions and the Complaints Procedure and that they agree to them.
- The contract is concluded at the moment the Seller confirms acceptance of the order by e-mail. The Seller may reject an order, in particular if the goods are out of stock or the Buyer does not meet the conditions of sale (e.g. age in the case of alcohol); in such a case, the Seller will refund all money received or release the hold on the card.
- The contract (order) is archived by the Seller in electronic form and is available to the Buyer in their account and in the confirmation e-mail.
5. Payment
- The Buyer may pay by payment card, Apple Pay or Google Pay through the payment service provider Stripe.
- For orders containing meat, the maximum price is blocked (authorised) on the card when the order is placed. After the pieces are weighed before dispatch, only the actual price is charged to the card; the remainder of the hold is released. The time it takes to release the remainder of the hold depends on the Buyer's bank.
- Approved businesses may pay by invoice with the payment term stated in the confirmation of their wholesale account.
- The Seller issues the tax document (invoice) after weighing and payment and sends it by e-mail.
6. Sale of Alcohol
- We sell alcoholic beverages only to persons over 18 years of age (zákon č. 65/2017 Sb. – Act No. 65/2017 Coll.). The Buyer confirms this when placing the order.
- The carrier may verify the recipient's age upon handover. If the recipient does not prove their age, the alcohol will not be handed over and the Seller will refund its price.
7. Delivery and Acceptance of Goods
- We deliver the goods chilled in a thermal box to the Czech Republic, Slovakia, Austria, Slovenia, Poland and Hungary. Delivery prices and options are stated in the order.
- We dispatch goods from Monday to Wednesday so that they do not remain in transit over the weekend; we deliver from Tuesday to Friday. The Buyer selects the delivery date in the order. The date is indicative; the Seller is not liable for delays caused by the carrier but will inform the Buyer.
- The Buyer is obliged to accept the goods on the agreed date and to place them in cold storage immediately. If the Buyer does not accept the goods, the meat cannot be resold due to the nature of the goods; in such a case, the Buyer bears the price of the goods and the delivery costs, unless the Buyer is not at fault for the failure to accept them.
- Upon acceptance, check that the packaging is intact. Report any damage to the shipment to the carrier and notify us as soon as possible (ideally with a photograph).
- The risk of damage to the goods passes to the Buyer upon acceptance.
8. Withdrawal from the Contract (Consumers)
- A consumer may withdraw from a contract concluded at a distance without giving any reason within 14 days of accepting the goods.
- This right does not apply to chilled meat, as these are goods liable to deteriorate rapidly (§ 1837 písm. d) občanského zákoníku – Section 1837(d) of the Civil Code). Rights arising from defective performance are not affected.
- For wine and other non-perishable goods, the consumer may withdraw by sending a statement to the e-mail address pedidos@piantado.cz or to the Seller's address, for example using the model form below. The deadline is met if the consumer sends the withdrawal before it expires.
- The consumer shall send or hand the goods back to the Seller within 14 days of withdrawal. The direct costs of returning the goods are borne by the consumer.
- The Seller will refund the money received, including the cost of the cheapest delivery method offered, within 14 days of withdrawal, using the same means by which it was received. The Seller is not required to refund the money before receiving the goods or before the consumer proves that they have been sent. The consumer is liable for any diminished value of the goods resulting from handling them other than as necessary to become acquainted with them (e.g. an opened bottle).

9. Rights Arising from Defective Performance
Rights arising from defective performance and the complaints procedure are governed by the Complaints Procedure.
10. Businesses (Wholesale)
- A business may apply for a wholesale account in the Shop. The Seller verifies its details (Commercial Register, ARES, VIES) and decides on approval at its own discretion.
- An approved business purchases at wholesale prices, subject to the minimum order value stated in the Shop and, where applicable, with payment by invoice up to the assigned limit.
- The provisions on withdrawal from the contract under Article 8 do not apply to businesses. Businesses must report defects in the goods without undue delay after acceptance, and no later than within 24 hours.
- The goods remain the property of the Seller until the purchase price has been paid in full. In the event of late payment, the Seller may suspend further deliveries and claim default interest at the statutory rate.
11. Out-of-Court Dispute Resolution and Supervision
- Complaints are handled by the Seller at the e-mail address pedidos@piantado.cz.
- The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Praha 2, www.coi.cz, is competent for the out-of-court resolution of consumer disputes.
- Compliance with regulations is supervised by the Czech Trade Inspection Authority, the Czech Agriculture and Food Inspection Authority (Státní zemědělská a potravinářská inspekce) (www.szpi.gov.cz) and the competent Trade Licensing Office (živnostenský úřad).
12. Online Advisor
An online advisor using artificial intelligence is available on the website. It helps with choosing goods and may add goods to the basket only on the Buyer's instruction; the order is always completed and paid for by the Buyer themselves. The advisor's answers are for information only; the details in the order and these Terms and Conditions are binding.
13. Final Provisions
- The processing of personal data is described in the Privacy Policy.
- The Seller may amend these Terms and Conditions; the version in effect at the moment the order is submitted applies to that order.
